Alan Gomez

Alan Gomez was called to the Malaysian Bar in 1997 and commenced his career as an associate in one of the largest firms in Malaysia. He was an integral part of TOMMY THOMAS at its inception and was invited to become a Partner of the firm in 2003.

In the course of his career, Alan has acquired a wide range of experience in Corporate and Commercial Litigation. He has developed a particular interest in the fields of Company Law, Insolvency, Business Disputes, Contracts, Sale of Goods, Commercial Contracts, Intellectual Property and Banking.

Alan has appeared as Counsel and co-Counsel, in arbitrations and all the Courts of Malaysia; from the Magistrates Court up to the Federal Court. Alan is well regarded within the Commercial Bar, and has had the privilege of appearing in numerous high profile cases, having acted as co-Counsel for a consortium of financial institutions in a bonds dispute against the bond issuer, lead arranger and trustee at the Kuala Lumpur High Court, the first of its kind in Malaysia. He has also represented a consortium of local and foreign banks as Counsel in the largest foreclosure action in Malaysia, and continues to be called on to represent the interests of Malaysia’s leading Islamic bank in its major litigation.

His growing reputation within the banking and commercial circles has enabled Alan to demonstrate his expertise in information technology. This led to his appointment in disputes relating to the supply of core banking systems to financial institutions, with one such dispute having been referred to the ICC International Court of Arbitration.

Alan has had the privilege of acting for the Securities Commission Malaysia in matters relating to breaches of securities legislation. He has secured for the Securities Commission worldwide Mareva injunctions against the promoters of an international Ponzi scheme, leading to recovery and repatriation of the largest fund for investors in Malaysia.

Alan has contributed to leading Malaysian legal publications, and is a member of the Malaysian Institute of Arbitrators and the International Bar Association. In 2010, Alan was appointed as a member of the Kuala Lumpur Regional Centre for Arbitration’s Panel of Mediators.
